E-XHALE 6th Birthday Campaign Terms and Conditions

This is a promotional competition conducted in terms of section 36 of the Consumer Protection Act, 2008 ("CPA") and the regulations made under it. These Competition Rules, Terms and Conditions ("Terms") govern the E-XHALE 6th Birthday Campaign ("Campaign"), including the bundle offers, the weekly prize competitions, and the mystery gift offer described below. By participating in any way, you accept these Terms. A copy of these Terms is available free of charge on the Website for the duration of the Campaign and for a period thereafter, and may be requested at no cost from customerservice@e-xhale.com.
1. Definitions
In these Terms:
"E-XHALE", "we", "us", "our" means E-XHALE PTY LTD (registration number 2020/482539/07), of 141 Willow Road, Willow Road Business Park, Fairview, Port Elizabeth, Eastern Cape, South Africa, 6070.
"Campaign period" means 00:00 on 1 June 2026 to 23:59 on 30 June 2026, South African Standard Time.
"Website" means e-xhale.com.
"Competition" means any one of the weekly promotional competitions described in clause 6.
"Competition week" means each of the four consecutive periods within the Campaign period, as published on the Website, to which a Competition relates.
"Qualifying order" means a single order placed on the Website during a Competition week with a value of R500 (five hundred Rand) or more, including VAT and excluding delivery charges, that is paid in full and that has not been cancelled, refunded, charged back, or reversed.
"Entry" means a single entry into a Competition, obtained either automatically through a qualifying order under clause 5.2 or without purchase under clause 5.4.
"Participant" means a natural person who submits or generates a valid Entry.
"Winner" means a Participant selected in accordance with clause 7.
"Prize" means a prize described in clause 8.
2. The Promoter
The Promoter is E-XHALE PTY LTD, registration number 2020/482539/07, of 141 Willow Road, Willow Road Business Park, Fairview, Port Elizabeth, Eastern Cape, South Africa, 6070. All queries relating to this Campaign must be directed to customerservice@e-xhale.com.
3. Age restriction and eligibility
3.1. This Campaign is strictly limited to persons aged 18 (eighteen) years or older. The sale of nicotine products to, and the use of nicotine products by, persons under the age of 18 is prohibited.
3.2. The Campaign is open only to natural persons resident in the Republic of South Africa whose orders are placed for delivery to a South African address. Orders for delivery outside South Africa do not qualify for any part of this Campaign, and persons outside South Africa are not eligible to enter any Competition.
3.3. The following persons may not enter any Competition or win any Prize: the directors, members, partners, employees, agents, and contractors of E-XHALE PTY LTD or of any company in its group; any person who directly or indirectly controls or is controlled by E-XHALE; the suppliers of goods or services in connection with this Campaign; and the spouses, life partners, business partners, immediate family members, and natural or adoptive parents, children, and siblings of any of the foregoing.
3.4. We may require any Participant or Winner to provide proof of identity, age, and South African residence before an Entry is accepted or a Prize is awarded. We may withhold a Prize until satisfactory proof is provided and may, acting reasonably, disqualify a Participant or forfeit a Prize where such proof is not provided within the period we specify in writing.
4. Bundle offers
4.1. During the Campaign period, selected birthday bundles are offered at promotional prices displayed on the Website. No discount code is required; the promotional price applies automatically.
4.2. Bundle promotional prices may not be combined with any other discount code, voucher, promotion, or offer, and do not stack.
4.3. All bundles are offered while stocks last. Certain bundles are limited in quantity and may sell out before the end of the Campaign period. We are not obliged to restock any bundle and may withdraw any bundle at any time.
4.4. Bundles purchased during the Campaign are promotional purchases. In accordance with our Refund Policy, promotional purchases may not be returned or exchanged on the basis of a change of mind. This does not affect your statutory rights in respect of goods that are faulty, defective, unsafe, or not as described under the CPA, which remain governed by our Refund Policy, including the requirement to report any defect or damage within 48 hours of delivery together with supporting evidence.
5. How to enter the weekly competitions
5.1. There are two ways to enter, and entry by either method has an equal chance of selection. No purchase is necessary to enter or to win.
5.2. Entry with a qualifying order. Each qualifying order placed and paid during a Competition week automatically generates one (1) Entry into that week's Competition. There is no limit on the number of Entries a Participant may generate by this method: each separate qualifying order is a separate Entry. For example, three separate qualifying orders placed in the same Competition week generate three Entries into that week's Competition.
5.3. Entries do not roll over between weeks. An Entry applies only to the Competition for the week in which the qualifying order was placed and paid. To enter more than one weekly Competition, a separate qualifying Entry must be obtained in each relevant week.
5.4. Free entry, no purchase necessary. You may enter any weekly Competition without making any purchase. To do so, send an email to customerservice@e-xhale.com during the relevant Competition week, with the subject line "Birthday Competition Free Entry", stating your full name, date of birth, residential address, contact telephone number, and the Competition week you wish to enter. Each valid free-entry email received during a Competition week constitutes one (1) Entry into that week's Competition and carries the same chance of selection as an Entry obtained through a qualifying order. A maximum of one (1) free Entry per person per Competition week applies. Free entries are subject to the same eligibility requirements in clause 3 and the same exclusions in clause 9.
5.5. Entries that are illegible, incomplete, submitted outside the relevant Competition week, or that do not comply with these Terms are invalid.
6. The weekly competitions
6.1. There are four (4) weekly Competitions during the Campaign period, each relating to its own Competition week and each with its own Prize and its own pool of Entries.
6.2. Each weekly Competition draws only from valid Entries relating to that Competition week.
6.3. The Prizes are set out in clause 8. The Prize for each Competition week is also published on the Website and communicated through our email and social channels at or before the start of that week.
7. Selection of winners
7.1. Winners are selected by means of a random draw conducted using automated random-selection software, from the pool of all valid Entries for the relevant Competition week. The element of chance applies to every selection.
7.2. All draws for all weekly Competitions are conducted after the Campaign period has ended, on a date determined by us.
7.3. Only Entries that remain valid at the time of the draw are eligible for selection. Where an Entry was obtained through a qualifying order, that order must remain paid in full and must not have been cancelled, refunded, charged back, or reversed at the time of the draw. If an order is cancelled, refunded, charged back, or reversed for any reason before the draw, every Entry arising from that order is void and is excluded from the draw.
7.4. The selection of Winners is final. This clause does not limit any right a Participant may have to refer a dispute to the National Consumer Commission or a court, as contemplated in clause 17.
7.5. We will keep the rules of this Campaign and the records of all Entries and selection results for a period of at least 3 (three) years from the date of the relevant draw, and will make them available to the National Consumer Commission on request, as required by the CPA.
8. The prizes
8.1. Week one — Fuel. Five (5) Winners each receive one (1) Engen fuel voucher to the value of R1,000. Total value: R5,000.
8.2. Week two — Groceries. Five (5) Winners each receive one (1) Spar voucher to the value of R1,000. Total value: R5,000.
8.3. Week three — Year of vapes. One (1) Winner receives an E-XHALE store gift card to the value of R5,000 (including VAT), redeemable against products on the Website. Total value: R5,000.
8.4. Final week — Order back. Three (3) Winners each receive an E-XHALE store gift card equal to the value of the qualifying order that generated the selected Entry, up to a maximum of R5,000 per Winner. Where that order exceeded R5,000, the gift card is capped at R5,000. Where it was less than R5,000, the gift card equals the order value. Where the selected Entry was a free entry under clause 5.4, the gift card is to the value of R500. The gift card is store credit redeemable against products on the Website and is not a cash refund.
8.5. The total value of the Prizes in this Campaign is R30,000.
8.6. No Prize may be exchanged, transferred, or ceded to another person, and no cash alternative is available, except that we may substitute any Prize with a Prize of equal or greater value where the advertised Prize becomes unavailable for reasons beyond our reasonable control.
8.7. Store gift cards are subject to our standard gift card terms and any expiry period stated on the card. Third-party vouchers (including Engen and Spar) are subject to the terms of the relevant third-party issuer. We are not responsible for the acts, omissions, or insolvency of any third-party issuer, nor for any voucher that is lost after delivery to the Winner.
9. One prize per person and 30-day exclusion
9.1. A Participant may win only one (1) E-XHALE competition or giveaway in any rolling period of 30 (thirty) days.
9.2. A Participant who has won any E-XHALE competition or giveaway within the 30 (thirty) days immediately preceding a draw is excluded from that draw. Such a Participant may still submit or generate Entries, but each such Entry is void and is automatically excluded at the point of selection, and the software will select an alternative Winner in their place.
9.3. No Participant may win more than one (1) Prize across the four weekly Competitions in this Campaign. If the draw selects a Participant who has already won a Prize in this Campaign, or who is otherwise excluded under this clause 9, that selection is void and a replacement Winner is drawn.
9.4. This clause 9 applies regardless of the number of qualifying orders placed or Entries held by a Participant, and regardless of whether Entries were obtained by purchase or by free entry.
9.5. The purpose of this clause is to spread Prizes fairly across our customers. It is applied consistently to all Participants.
10. Notification and claiming of prizes
10.1. Winners will be notified privately by email, using the email address associated with the qualifying Entry, between 7 (seven) and 14 (fourteen) days after the end of the Campaign period. We may also announce Winners to our email subscriber list, subject to clause 15.4.
10.2. It is the Participant's responsibility to ensure that the contact details associated with their Entry are accurate and current. We are not liable for any failure to reach a Winner that results from incorrect, incomplete, or outdated contact details, provided we have made reasonable attempts to make contact.
10.3. A Winner must acknowledge our notification and accept the Prize within 7 (seven) days of the date of the notification, and must provide any information we reasonably require to verify eligibility and to deliver the Prize. If a Winner does not respond and accept within that period, declines the Prize, cannot be reached after reasonable attempts, or is found to be ineligible, the Prize is forfeited and we may draw a replacement Winner.
10.4. Accepted Prizes are delivered or issued within a reasonable period after acceptance and verification.
11. The mystery gift offer
11.1. Separately from the Competitions, any single order placed on the Website during the Campaign period with a value of R750 or more, including VAT and excluding delivery charges, will automatically include a complimentary mystery gift.
11.2. The mystery gift is not a Competition, not a Prize, and not awarded by draw. It is included with every qualifying order while gift stocks last.
11.3. The item given as the mystery gift is chosen by us, varies, and may not be chosen, exchanged, or substituted at the customer's request. The mystery gift has no cash value.
11.4. The mystery gift is offered while gift stocks last. If gift stock is exhausted before the end of the Campaign period, we may withdraw or substitute the offer. The absence of a mystery gift does not invalidate the order and gives rise to no refund or compensation.
11.5. If an order that included a mystery gift is returned, refunded, or cancelled, we may require the return of the mystery gift or deduct its retail value from any amount refunded.
12. Disqualification, fraud, and abuse
12.1. We may, acting reasonably, disqualify any Participant and void any Entry where we have reasonable grounds to believe there has been: fraud, dishonesty, or abuse of the Campaign; the use of bots, scripts, multiple or fake identities or accounts, or any means of generating Entries other than genuine qualifying orders or valid free entries; a material breach of these Terms; or conduct that is unlawful or that brings, or is likely to bring, E-XHALE into disrepute.
12.2. Orders that are placed and then cancelled, refunded, charged back, or reversed generate no valid Entry. Placing orders with the intention of cancelling or returning them to generate Entries is an abuse of the Campaign and grounds for disqualification.
12.3. Where we disqualify a Participant, we will, on request, give brief written reasons. Nothing in these Terms limits a Participant's right to refer a dispute as set out in clause 17.
13. Promoter's rights and changes to the campaign
13.1. We may amend, suspend, postpone, or cancel the Campaign, any Competition, or any part of it, where reasonably necessary, including for reasons beyond our reasonable control. We will act reasonably, will publish any such change on this page, and will not unfairly prejudice Participants who have already validly entered.
13.2. We may amend these Terms during the Campaign period where reasonably necessary. Amendments take effect when published on this page.
13.3. Stock of bundles, mystery gifts, and goods is limited and not guaranteed.
14. Liability
14.1. Subject to clause 14.3, and to the maximum extent permitted by law, E-XHALE and its directors, employees, and agents are not liable for any indirect, special, or consequential loss arising out of or in connection with this Campaign, any Competition, any Entry, the award or non-award of any Prize, or the use of any Prize.
14.2. We are not responsible for Entries, orders, or notifications that are lost, delayed, corrupted, or not received owing to technical failure, network or system error, or any cause beyond our reasonable control, provided we have not been grossly negligent.
14.3. Nothing in these Terms excludes or limits liability that may not lawfully be excluded or limited, including liability for death or personal injury caused by negligence, for fraud, or under the CPA. Your statutory rights are not affected by these Terms.
14.4. To the extent permitted by law, a Winner accepts a Prize at their own risk and indemnifies E-XHALE against any third-party claim arising from the Winner's use of the Prize, save where the claim arises from our gross negligence or wilful misconduct.
15. Personal information and POPIA
15.1. By entering, you consent to E-XHALE collecting and processing the personal information in your Entry, and any information you provide, for the purposes of administering the Campaign, conducting the draws, verifying and contacting Winners, and delivering Prizes.
15.2. We process personal information in accordance with the Protection of Personal Information Act, 2013 (POPIA) and our Privacy Policy, which forms part of these Terms and is available on the Website.
15.3. We do not sell personal information. We share it only as necessary to deliver a Prize (for example, with a voucher issuer or courier) or where required by law.
15.4. We will not publish a Winner's full name, image, or other identifying information without that Winner's prior consent. Any announcement to our subscriber list will be limited to the minimum information necessary and made only with such consent.
15.5. Participants may request access to, correction of, or deletion of their personal information by contacting customerservice@e-xhale.com, subject to our record-retention obligations under clause 7.5 and applicable law.
16. General
16.1. These Terms, together with our Terms of Service, Privacy Policy, and Refund Policy, constitute the entire agreement between you and us in respect of the Campaign.
16.2. If any provision is found to be invalid or unenforceable, it is severed to the minimum extent necessary and the remaining provisions continue in force.
16.3. Our failure or delay in enforcing any provision is not a waiver of it.
16.4. These Terms are governed by the laws of the Republic of South Africa.
17. Disputes
17.1. We would like the opportunity to resolve any complaint directly. Please contact us first at customerservice@e-xhale.com so that we can try to resolve the matter.
17.2. Nothing in these Terms prevents a Participant from referring a dispute to the National Consumer Commission, the Consumer Goods and Services Ombud, or a court of competent jurisdiction in the Republic of South Africa, and you submit to the jurisdiction of the South African courts.
